Terms and conditions of the LegalPyro.de online shop

which lays down, among other things, the rules for the conclusion

of sales contracts through the shop, including the most important

information about the Seller, the shop and the consumer's rights.

§ 1 DEFINITIONS

Working days - days from Monday to Friday with the exception of

public holidays.

Account - a free-of-charge function of the Store (service

provided electronically) regulated by separate regulations,

thanks to which the Buyer may set up his individual Account in

the Store.

Consumer - a consumer within the meaning of the Civil Code.

Buyer - any entity purchasing from the Store.

Rules and Regulations - these Rules and Regulations.

Shop - online shop LegalPyro operated by the Seller at

www.LegalPyro.de.

§ 2 CONTACTING THE SELLER

§ 3 TECHNICAL REQUIREMENTS

(1) For the proper functioning of the Store requires:

a device with Internet access

web browser supporting JavaScript and cookies.

(2) For placing an order in the Store, in addition to the

requirements specified in paragraph 1, an active e-mail account

is necessary.

§ 4 SHOPPING IN THE SHOP

(1) The prices of goods shown in the Shop are the total prices

for the goods, including VAT.

(2) The Seller points out that the total price of the order

consists of the price for the goods indicated in the Store and,

if applicable, the cost of delivery of the goods.

(3) The goods selected for purchase should be added to the

shopping cart in the Store.

(4) The Buyer then chooses from the available in the Store: the

method of delivery of the goods and the method of payment for the

order, and provides the data necessary to complete the order

placed.

(5) An order is placed when the Buyer confirms its contents and

accepts the Terms and Conditions.

(6) Placing an order is tantamount to concluding a sales

contract between the Buyer and the Seller.

(7) The Seller shall provide the Consumer with confirmation of

the conclusion of the contract of sale on a durable medium at the

latest upon delivery of the goods.

(8) The Buyer may register with the Store, i.e. create an

Account therein or make purchases without registering by

providing his/her data with each order.

(9) Foreign shipments are sent at the responsibility of the

ordering person, we are not responsible for packages lost or

undelivered in foreign trade.

10. PURCHASES CAN ONLY BE MADE BY A PERSON OF FULL AGE

§ 5 PAYMENTS

An order placed can be paid for, at the Buyer's option:

1. by ordinary bank transfer to the Seller's bank account.

2. via the payment platform:

(1) If the Buyer chooses to pay in advance, the order must be

paid for within 2 working days of placing the order.

(3) The Seller informs that in the case of some payment methods,

due to their specificity, paying for the order by this method is

only possible immediately after placing the order.

(4) By purchasing from the Store, the Buyer accepts the use of

electronic invoices by the Seller. The Buyer has the right to

withdraw his acceptance.

§ 6 CONTRACT PERFORMANCE

(1) The seller is obliged to deliver goods without defects.

(2) The lead time of the order is indicated in the Shop.

(3) In the event that the Buyer has chosen to pay in advance

for the order, the Seller will proceed to fulfill the order after

it has been paid.

(4) In the event that the Buyer has purchased goods in one order

with different lead times, the order will be fulfilled within the

time limit applicable to the goods with the longest lead time.

(5) Goods purchased in the Store are delivered depending on the

method of delivery chosen by the Buyer:

1. through the courier company

(6) If the Buyer chooses to collect the goods in person, the

goods will be ready for collection on the indicated date of

completion of the order, and if the Seller indicated the date of

dispatch of the goods - within this period.

(7) overseas shipments are sent at the responsibility of the

person ordering, we are not responsible for packages lost or

undelivered in overseas traffic.

(8) Order processing time is 1-2 working days from receipt of payment.

§ 7 RIGHT OF WITHDRAWAL

(1) The consumer has the right to withdraw from the contract

concluded with the Seller through the Shop, subject to § 8 of the

Terms and Conditions, within 14 days without giving any reason.

(2) The period of withdrawal shall expire after 14 days from the

date:

1. on which the Consumer came into possession of the goods or on

which a third party other than the carrier and indicated by the

Consumer came into possession of the goods.

2. on which the Consumer has taken possession of the last of the

goods or on which a third party, other than the carrier and

indicated by the Consumer, has taken possession of the last of

the goods in the case of a contract involving the transfer of

ownership of multiple items which are delivered separately.

3. conclusion of the contract - in the case of a contract for

the supply of digital content.

(3) In order for the Consumer to exercise his/her right of

withdrawal, he/she must inform the Seller, using the data

provided in § 2 of the Terms and Conditions, of his/her decision

to withdraw from the contract by an unequivocal statement (for

example, a letter sent by post or information transmitted by e-

mail).

(4) The consumer may use the model withdrawal form at the end of

the Terms and Conditions, but it is not obligatory.

(5) In order to meet the withdrawal deadline, it is sufficient

for the Consumer to send information concerning the exercise of

his or her right of withdrawal before the expiry of the

withdrawal period.

EFFECTS OF WITHDRAWAL FROM THE CONTRACT (

6) In the event of withdrawal from the concluded contract the

Seller shall return to the Consumer all payments received from

him less the costs of delivering the goods immediately, and in

any case no later than 14 days from the day on which the Seller

received the return shipment.

(7) The Seller shall refund the payment using the same means of

payment that were used by the Consumer in the original

transaction, unless the Shop and the Consumer agree on a

different solution.

(8) The Seller shall withhold reimbursement of payments until

the goods have been received.

(9) The Seller asks to return the goods to the address: Ożarowice, Podłączna 75A, 42-625immediately and in any case no later than 14 days from the day on which the Consumer informed the Seller about withdrawal from the sales contract. The deadline is met if the Consumer sends back the goods before the expiry of the14-day period.

(10) The Consumer shall bear the direct costs of returning the

goods.

§ 8 EXCEPTIONS TO THE RIGHT OF WITHDRAWAL

(1) The right of withdrawal from a contract concluded at a

distance shall not be granted to the Consumer in respect of a

contract:

1. in which the object of the performance is a non-refabricated

thing, produced according to the Consumer's specifications or

serving to satisfy his/her individualised needs.

2. in which the object of the performance is an item that is

perishable or has a short shelf life.

3. in which the subject matter of the performance is an item

supplied in sealed packaging which cannot be returned after

opening for health or hygiene reasons, if the packaging has been

opened after delivery.

4. in which the subject matter of the performance is things

which, after delivery, by their nature become inseparable from

other things.

5. in which the subject matter of the performance is sound or

visual recordings or computer programs delivered in sealed

packaging if the packaging has been opened after delivery.

6. for the supply of newspapers, periodicals or magazines,

except for a subscription contract.

7. where the price or remuneration is dependent on fluctuations

in the financial market which are beyond the trader's control and

may occur before the end of the withdrawal period.

8. for the supply of digital content which is not recorded on a

tangible medium if the performance has begun with the consumer's

express consent before the end of the withdrawal period and after

the trader has informed the consumer of the loss of the right of

withdrawal.

(2) A person other than the Consumer has no right of withdrawal

from a distance contract.

§ 9 COMPLAINTS

(1) In the event of a defect in the goods, the Buyer has the

opportunity to claim faulty goods on the basis of the warranty

regulated by the Civil Code or the guarantee, if a guarantee was

granted.

(2) Using the warranty, the Buyer may, under the terms and

within the time limits specified in the Civil Code:

1. make a declaration to reduce the price

2. in the case of a material defect - make a declaration to

withdraw from the contract

3. demand the replacement of the item with a defect-free item

4. demand the removal of the defect3. The Seller asks to submit complaints on the basis of the

warranty to the postal or electronic address indicated in § 2 of

the Terms and Conditions.

(4) If it turns out that in order to consider the complaint it is

necessary to deliver the advertised goods to the Seller, the

Buyer is obliged to deliver the goods at his own expense to the

address SABSTR Covenant SP.Z.O.O Podłączna 75A 42-625 Ożarowice

5. If the goods have an additional warranty, information about

it, as well as about its conditions, is available in the product

description in the Store.

(6) Complaints concerning the operation of the Store should be

sent to the e-mail address specified in § 2 of the Rules and

Regulations.

7th Complaints will be considered by the Seller within 14 days.

OUT OF COURT CLAIMS DISPUTES AND CLAIMS DISPUTES

8. In the event that the complaint procedure fails to produce the

result expected by the Consumer, the Consumer may

make use of, among other things:

1. mediation conducted by the locally competent Provincial

Inspectorate of Trade Inspection, to which a request for

mediation should be submitted. As a rule, the proceedings are

free of charge. The list of Inspectorates can be found here:

2. the assistance of a locally competent permanent amicable

consumer court operating at the Provincial Inspectorate of Trade

Inspection, to which a request for consideration of the case

before the amicable court should be submitted. As a rule, the

proceedings are free of charge. The list of courts is available

3. the free assistance of the municipal or district consumer

ombudsman.

4. the online ODR platform available at:

http://ec.europa.eu/consumers/odr/.

§ 10 PERSONAL DATA

(1) The administrator of the personal data provided by the Buyer

when using the Shop is the Seller.

(2) The Buyer's personal data is processed mainly on the basis

of the agreement and for the purpose of its implementation, in

accordance with the principles set out in the General Regulation

of the European Parliament and of the Council (EU) on data

protection (RODO). Detailed information on the processing of data

by the Seller is contained in the privacy policy posted in the

Shop.

§ 11 RESERVATIONS

(1) The provision of unlawful content by the Buyer is prohibited.

(2) Each order placed in the Shop constitutes a separate sales

contract and requires a separate acceptance of the Terms and

Conditions. The contract is concluded for the time and purpose of

fulfilling the order.

(3) Contracts concluded under these Terms and Conditions shallbe concluded in the Polish language.

(4) In the case of a possible dispute with the Buyer who is not

a Consumer, the competent court shall be the court with

jurisdiction over the seat of the Seller.

(5) None of the provisions of these terms and conditions does

not exclude or in any way limit the rights of the Consumer under

the law.

(6) The provisions relating to goods and the contract of sale

shall apply accordingly to the digital content and the contract

for the supply of digital content, unless these Terms and

Conditions specify these matters separately.
